A wake is considered to be visible whitewater in the eyes of the law and your 10 hp can certainly make that. Where exactly was this marker, I would like to see it?
Did it possibly say 'SLOW NO WAKE'?

Plus if you don't see one and you are traveling faster than 5 mph then your breaking the law. It is not hard to make a wake but it has nothing to do with a "white cap".Sorry I'll bet we have all seen a boat make a wake that is huge and did not show any white caps...like a big slow roller off the back of a real big cabin cruiser.
